This Return & Refund Policy (the “Policy”) applies to purchases of Landish Products made directly from landish.ca for delivery to addresses in Canada. It forms part of, and should be read together with, our Terms of Use and Terms of Sale.
This Policy does not apply to purchases of Landish products made through any other websites, marketplaces, retailers, distributors, or wholesale channels (including but not limited to wholesale.landish.ca, landish.co, or third-party retailers, whether online or in-store). For such purchases, you must contact the merchant or platform from which you purchased the product and follow its applicable policies. We do not provide refunds or returns for products purchased anywhere other than landish.ca under this Policy.
Nothing in this Policy is intended to limit any rights or remedies you may have under applicable consumer protection laws, including statutory or legal warranties that may apply to your purchase.
For most Products purchased on landish.ca, we offer a simple, no-questions-asked return policy within thirty (30) days from the date the order is marked as delivered by the carrier (the “Return Window”). Returns requested after the Return Window has expired will generally not be accepted except where required by law.
To be eligible for a return under this Policy, you must: (a) request the return within thirty (30) days from the date of delivery as recorded by the carrier; and (b) return at least ninety percent (90%) of the Product’s original net weight (as indicated on the Product packaging). We reserve the right to verify the returned quantity and to adjust or deny refunds where the returned amount is less than 90% of the original net weight.
Certain Products are non-returnable and non-refundable under this Policy, except where required by law (for example, in the case of defective Products covered by statutory or legal warranties). The following specific Products are non-returnable under our standard policy:
• Pure Canadian Hydrolyzed Marine Collagen 1 kg and 750 g;
• Marine Collagen Sparkling Waters;
• Creatine Monohydrate 1 kg; and
• Marine Collagen Gummies 240 count.
In addition, any large-format Product for which a smaller format of the same Product is available (for example, a large bulk size where a smaller size of the same Product is also offered) is considered non-returnable under this Policy, except where required by law. We may specify additional non-returnable Products on the Site from time to time.
If you are unsure whether a Product is returnable, please contact us at hello@landish.ca before opening it or consuming a significant portion.
Our standard return policy is intended to give you the opportunity to try our Products while also preventing abuse. Accordingly, for a Product to be eligible for a refund under this Policy (other than in the case of a defective or incorrect item):
• You may open and try the Product; and
• You must return at least ninety percent (90%) of the Product’s original net weight (as indicated on the packaging).
We may weigh returned Products (or otherwise verify the quantity) and may, in our discretion, reduce or deny a refund where less than 90% of the Product’s original net weight is returned. We may also limit or refuse returns where we suspect abuse of this Policy, including repeated returns by the same customer.
If an item in your order is damaged (other than as a result of temperature or environmental exposure as described in Section 9 below), defective, or incorrect (for example, the wrong Product was shipped), please contact us promptly at hello@landish.ca within thirty (30) days from the date of delivery. When you contact us, please include: (a) your order number; (b) a description of the issue; and (c) clear photos of the Product, packaging, and shipping label, as applicable.
If we confirm that a Product was damaged, defective, or incorrect at the time of delivery, we will, at our option and subject to applicable law: (a) send you a replacement Product at no additional charge; or (b) issue a refund to your original payment method for the affected Product(s). In such cases, if we request that the Product be returned, we will provide a pre-paid return shipping label and cover the cost of return shipping.
To request a return under this Policy, please follow these steps:
1. Contact us at hello@landish.ca within the applicable timeframe (generally within thirty (30) days from the date of delivery) and include your order number and the items you wish to return, together with a brief explanation of the reason for the return (optional for standard returns; required for damaged or defective items).
2. We may provide you with return instructions, which may include a return authorization number or form, the return address, and any specific packaging or labelling requirements.
3. Unless we provide you with a pre-paid return label (for example, for incorrect or defective items), you are responsible for arranging and paying for return shipping using a carrier of your choice. We recommend using a trackable shipping service and retaining proof of shipment. We are not responsible for returns that are lost, misdirected, or damaged in transit.
4. Once we receive and inspect your return, we will notify you by email whether your return has been approved and, if so, the amount of the refund to be issued.
For standard returns where you have simply changed your mind, are dissatisfied with a Product for personal reasons (such as taste), or otherwise wish to return a Product that is not defective or incorrect, you are responsible for the cost of return shipping. We will not reimburse shipping costs in such cases.
For returns due to our error (for example, where we shipped the wrong Product or quantity) or where a Product is confirmed to be defective or damaged at the time of delivery (other than temperature-related damage as described in Section 9), we will provide you with a pre-paid return label where a physical return is required and will bear the cost of return shipping.
Approved refunds will generally be issued to the original payment method(s) used for the purchase, subject to the following. For amounts paid by credit card, debit card, PayPal, or other non-Gift Card payment methods, refunds will be issued back to that method where possible. For amounts paid using Gift Cards, refunds will be reissued to a Gift Card; we will not provide cash refunds or refunds to other payment methods for amounts paid with a Gift Card, except where required by law. If an order was paid using both a Gift Card and another payment method, we will generally refund first to the other payment method up to the amount originally charged to that method and then, if necessary, to a Gift Card, in accordance with our Terms of Use and Terms of Sale.
If an order or portion of an order was paid using Promotional Credits, we may, in our discretion and subject to applicable law and the original Promotion terms, re-credit Promotional Credits to your account or apply another remedy. Promotional Credits have no independent cash value and are not refundable as cash.
Once your return has been received and processed, please allow a reasonable period (typically up to 10 business days) for the refund to be reflected on your payment method statement. Processing times may vary depending on your financial institution.
Shipping fees paid on the original order are generally non-refundable, except where required by law or where the return is due to our error or a confirmed defect in the Product.
Some Products may be sensitive to heat or cold, particularly during warmer or colder months and when packages are left outdoors or in uncontrolled environments for extended periods. You are responsible for providing a delivery location where packages can be safely delivered and for ensuring that shipments are retrieved promptly upon delivery.
To the fullest extent permitted by applicable law, Landish is not responsible for damage to Products caused solely by exposure to temperature or environmental conditions during shipping or after delivery, including where a carrier leaves a package outdoors, in a lobby, or at another location at or near your address. This includes, without limitation, changes in texture, separation, melting, freezing, or other cosmetic or quality changes arising from temperature exposure, where the Product otherwise continues to meet applicable legal warranty standards.
We may, in our sole discretion and on a case-by-case basis, decide to replace or refund Products affected by temperature-related issues as a courtesy. Any such accommodation is voluntary and does not create a binding obligation to provide similar accommodations in the future.
This Policy applies only to Products purchased directly from landish.ca. Products purchased elsewhere – including but not limited to landish.co, fr.landish.ca, wholesale.landish.ca, marketplaces (such as Amazon or other platforms), grocery or specialty stores, pharmacies, and other retailers or distributors – are not eligible for returns or refunds through this Site.
If you purchased a Landish product from another merchant, you must contact that merchant and follow its return or refund procedures. This Policy does not affect any rights you may have directly against that merchant or under applicable law.
If you purchased a bundle, kit, or other multi-Product offering (including where Products are offered at a discount when purchased together), you may in some cases return individual items from the bundle rather than the entire bundle. However, the refund amount will be adjusted to reflect the promotional pricing actually received.
If your order included a free or heavily discounted promotional item (for example, a “free gift with purchase” or a $0 or heavily discounted item tied to a minimum spend or quantity threshold), and you return some or all of the other items from that order, the following will apply:
• If you return the promotional item along with the other eligible items, your refund will be calculated based on the actual amount you paid for the returned items, taking into account the promotion; or
• If you do not return the promotional item, we may deduct from your refund an amount equal to the then-current regular (non-promotional) price of that promotional item, such that you effectively purchase the promotional item at its normal price.
We reserve the right to limit or refuse returns of bundles or promotional orders where doing so would be inconsistent with the spirit or terms of the Promotion, or where we suspect abuse (for example, repeatedly placing and returning orders in order to obtain free gifts).
Subscription orders placed through landish.ca are subject to this Policy in the same manner as non-subscription orders. You may request returns for eligible subscription orders within the same 30-day Return Window and subject to the same conditions (including the 90% net weight requirement and non-returnable Product rules).
Cancelling a subscription prevents future automatic orders but does not automatically cancel or refund any orders that have already been accepted or fulfilled. Returns and refunds for such orders will be handled in accordance with this Policy and applicable law.
We reserve the right to monitor returns and refund activity and to investigate patterns that may suggest abuse of this Policy, including but not limited to: frequent returns, returns inconsistent with typical use, repeated claims of non-delivery or temperature-related damage, or other suspicious behavior.
Where we reasonably determine that a customer has abused this Policy, engaged in fraudulent activity, or otherwise acted in bad faith (including by attempting to “game” Promotions or referral programs), we may, to the fullest extent permitted by law: (a) deny future returns or refunds; (b) cancel or refuse orders; (c) revoke referral or promotional benefits; and/or (d) suspend or permanently ban that customer’s access to landish.ca and our other websites.
Any such actions will be taken without limiting any other rights or remedies available to us under these Terms, our other policies, or applicable law.
We may update or modify this Policy from time to time. When we do so, we will update the “Effective date” above and may provide additional notice on the Site where appropriate. Any changes will apply to purchases made on or after the effective date of the updated Policy. For purchases made before that date, the Policy in effect at the time of your purchase will generally apply, except where a change is required by law and is more favorable to you.
